AMENDMENTS TO THE EIA REGULATIONS

The Minister of Environmental Affairs has, in terms of sections 24(2), 24(5) and 44, read with section 47 the National Environmental Management Act 107 of 1998, given notice of her intention to amend the Environmental Impact Assessment Regulations, 2014 ("Regulations") as well as the listed activities set out in Listing Notices 1, 2 and 3 of 2014 ("Listing Notices 1, 2 and 3").
The amendments proposed to be affected to the Regulations include, inter alia, the insertion of regulation 54A pertaining to transitional arrangements in respect of prospecting, exploration, extraction or primary processing of mineral or petroleum resources.
The amendments proposed to be effected to the Listing Notices 1 and 2 pertain to the following listed activities -
- Activity 1 of Listing Notice 1;
- Activity 19 of Listing Notice 1;
- Activity 32 of Listing Notice 1;
- Activity 36 of Listing Notice 1;
- Activity 48 of Listing Notice 1;
- Activity 49 of Listing Notice 1;
- Activity 67 of Listing Notice 1;
- Activity 1 of Listing Notice 2;
- Activity 21 of Listing Notice 2; and
- Activity 27 of Listing Notice 2.
Listing Notice 3 is proposed to be repealed by the Listing Notice 3 as set out in this notice.
Members of the public are invited to submit written comments within 30 days of publication of this notice (i.e. on or before 30 November 2015).
